Research On The Legal System Of Blockchain Finance Supervision

With the rise of financial technology in the global area,blockchain technology has attracted widespread attention from governments and financial institutions around the world since its birth.In 2015,blockchain technology has completed deep industrial integration in the global financial field.It has realized the leap from blockchain financial concept to blockchain financial products,bringing unprecedented innovation and transformation to the entire financial system business.2018 is a year in which blockchain technology has been widely used in China's financial sector.Digital currency,banking,securities,and insurance industries have used blockchain innovation to create new financial models.While blockchain finance brings financial innovation,it also has a subversive impact on China's current financial system.How to effectively supervise blockchain finance is an urgent problem to be solved.At present,China has a lot of loopholes and lags in the financial supervision of blockchain,which is not conducive to promoting the innovation and development of China's financial industry.This paper mainly uses literature method,comparative research method and other methods to analyze the application and supervision status of blockchain finance,and proposes suggestions for perfecting China's blockchain financial supervision legal system based on the complete supervision experience of extraterritorial countries.This paper describes the four parts of the legal system of blockchain financial supervision.The first part is a detailed explanation of the basic theory of blockchain financial supervision.Firstly,it introduces the concept of blockchain technology and blockchain finance.Secondly,it introduces the basic situation of blockchain finance and clarifies the concrete manifestation of blockchain finance.Then,it analyzes the specificity of blockchain financial supervision.Content and particularity.The second part introduces the blockchain financial supervision legal system in developed countries.This part mainly introduces the blockchain financial supervision legal system in the United States,the United Kingdom,the European Union and Japan,and summarizes the experience from the aspects of regulatory legislation,regulatory subjects and regulatory measures.It has important implications for the establishment of a legal system for blockchain financial supervision in China.The third part is to analyze the current situation and existing problems of China's blockchain financial supervision legal system.China's current legal system for blockchain financial supervision is relatively lagging behind,mainly reflected in: the legal system is not sound enough;there is no innovative regulatory mechanism;the regulatory body is not clear;the regulatory system is not perfect.The fourth part puts forward some suggestions for the improvement of China's blockchain financial supervision legal system.Establishing China's blockchain financial supervision legal system by perfecting general law and special law;innovating the supervision mechanism,introducing “sandbox supervision”;defining the regulatory body;completing pre-,postand post-event supervision and financial consumers from the financial market Improve the specific regulatory legal system for blockchain finance in terms of rights protection supervision and other aspects.
