Based on the Criminal Law Amendment the 8th and the relevant judicial interpretation of the crime of pollution of the environment,and combined with the latest judicial practice to face the problems,in view of the subjective form of crime of pollution of the environment theory,this paper makes a thorough analysis and discussion of the practical disputes,clarifies the related issues involved,and strives to form a logical,rigorous and perfect progressive penalty system.We should actively and extensively refer to the provisions and requirements of relevant international treaties,fully draw lessons from the concept of setting up frontier countries,sufficiently incorporate the reasonable content of its setting into the legal framework of our country,and accelerate the process of forming an export-oriented environmental criminal law that cooperates with international environmental crime.The full text is divided into four parts.The first part is mainly based on the analysis of the big data of the existing judicial decisions and the selection of the typical cases.The relevant data and typical cases are analyzed,summarized and summarized,and the problems worth studying and discussing are drawn.The second part is mainly about the display of the existing theories,summarizing the advantages and disadvantages of each theory.The third part is to explain and explain the construction of the viewpoints put forward by the author;the fourth part is to further elaborate and demonstrate the necessity and rationality of the viewpoints put forward by the author to solve the existing judicial practice problems by combining with the classical cases put forward in the first part.This is the main framework of this paper.
