In order to comply with the situation of China's international anti-corruption pursuit,China has added illegal income confiscation procedures to help more efficient pursuit of the legal system,but the overseas pursuit under the application is different from the domestic,especially the special context.International judicial cooperation.In the face of international judicial cooperation,the illegal income confiscation procedure has its own unique features,such as strict application of rules and compatibility with coexistence.Moreover,the United Nations Convention against Corruption has established universal norms for asset recovery procedures,and the National Mutual Legal Assistance Law has provided the basis for asset recovery assistance.In view of the above research background,the legislative issues of the unclear legislation,the scope of application,the improper starting conditions,and the protection of the rights of interested parties in the current illegal income confiscation procedures in China have surfaced and are worth exploring.Extraterritorial reference to the relevant system for legislative adjustments,in order to improve the application rate of illegal income confiscation procedures,improve the efficiency of overseas tracking.
