Research On The Characteristics,Attributes And Contents Of Personal Data Rights In The Data Age

The development of information technology has brought great changes to people's life.In the era of big data,we seem to be living in a world of cross-flow of data.While data,all sorts of which flow ceaselessly,created tremendous value,magnanimity and high speed current data also become hard to control.At the same time,the establishment of data management system and relevant laws shows a certain lag,and the lack of data flow management,resulting in a variety of data chaos,then data security issues began to highlight.Among them,personal data is closely related to citizens' own interests,so the problems caused by it are highly valued.Personal data infringement and crime are frequent,such as illegal collection,processing,disclosure,buying and selling,concurrent use of personal data illegal steal property,telecommunications fraud.Therefore,clearing on the rights of personal data and increasing the legal rights to personal data protection,not only become the main content of the legislative research around the world,but become a hot spot of academia.However,at present,there are still many controversies in the research on the theory of personal data rights,which makes the legislation of personal data rights difficult.Therefore,clarifying the concept and category of personal data rights,distinguishing the basic attributes and rights content of personal data rights,and enriching the theoretical research on personal data rights will play a positive role in promoting the process of legislation on personal data rights in China.In this paper,the literature investigation method,logical analysis method,deductive case analysis method and comparative analysis method are used to study the relevant problems.The introduction part elaborates the current situation of legislation and research on personal data rights at home and abroad,and finds out the deficiency of existing research and the trend of future research.The second chapter analyzes and defines the concept of personal data and personal data rights,and explains the interrelationshipbetween personal data and similar concepts and confusable concepts.The third and fourth chapters,combining with the previous studies and comparing with the current legislation at home and abroad,discuss the basic characteristics and content of personal data rights.The fifth chapter,through the analysis of two typical cases of personal data right infringement in China,further affirms the analysis of the attribute and content of personal data rights.The last chapter summarizes the above discussion,elaborates the existing problems in China's current personal data rights protection found in the above research and comparative analysis,and puts forward feasible Suggestions for the problems.
