Research On The Civil Public Interest Litigation System Of Procuratorial Organs In China

Public interest litigation plays an important role in the protection of public interests.With the deepening of academic research and practical exploration,it has reached a common understanding of the procuratorial organization as the main body to bring up public interest litigation.The procuratorial organization have explored and practiced in the field of public interest litigation for many years,but only limited to the supportive prosecution for vulnerable groups and to the supervision prosecution of state assets.The resolution of Central Committee of the Communist Party of China on Major issues Concerning the Enhancement of all-round law-based Governance adopted at the fourth plenary session of the 18th Communist Party of China(CPC)Central Committee proposed ?to explore and establish the system of the procuratorial organization bring up public interest litigation.On July 1,2015,15th session of the 12th NPC Standing Committee made the decision of the NPC Standing Committee on the authorization of the Supreme People's Procuratorate to launch the public interest litigation pilot project in some parts of the country".The resolution authorized to carry out the public interest litigation pilot work in 13 cities including Beijing,Inner Mongolia,Jilin and so on from July 1,2015 to June 30,2017.On June 27,2017,the 28th session of the 12th NPC Standing Committee passed the resolution on revising the Civil Procedure Law of the People's Republic of China and the Administrative Litigation law of the People's Republic of China,the decision is to be put into effect from July 1,2017,and officially gives the prosecution the right to bring up public interest litigation,which has already been deployed nationwide.At present,the state pays special attention to issues related to people's livelihood,civil public interest litigation filed by the procuratorate also conforms to the situation,and especially our state pays more attention to people's livelihood issues on the ecological environment,food and drug areas.The text is based on the study of civil public interest litigation brought up by procuratorial organizations in Tianjin and around the country,through the analysis of the implementation of procuratorial organizations filing civil public interest litigation in pilot areas and Tianjin to analyze existing problems,drawing lessons from the foreign civil public interest litigation,to improve the of the civil public interest litigation brought up by the procuratorial organization system design.
