Research On Remote Traill In Internet Era

Information technology continues to penetrate the judicial field and catalytic new changes in the judicial system.As the product of the integration of modern information technology and judicial system,the remote trial is not only the exploration result of the reform in the judicial field adapting to the information age,but also the innovative construction of the judicial system to meet the objective needs of its own development and promote the modernization of the judicial ability of the trial system.However,the development of remote trial in various parts of China is still in the exploration initial stage with the undeveloped type.The judicial practice encountered a vague scope of receiving cases,remote trial application platform confusion,the probability of false litigation,increased technical dependence,resource integration and other issues.And moreover,the exploration of the way of remote trial in practice is still in the practical stage of justice,and there is a lack of inquiry into its institutional connotation and value connotation.Therefore,starting from the concept and characteristics of the remote trial mode,this paper expounds the era significance of the remote trial,and explores the tool efficiency and value priority of the remote trial deeply,as well as compare with domestic implementation with foreign practical experience,tries to improve the level of judicial modernization in Shanxi through the system design of the development of the remote trial mode in Shanxi.The thesis is divided into four parts:The first part probes into the theoretical basis of the remote trial.This paper introduces the concept and characteristics of the remote trial,emphatically analyzes the nature of the remote trial,expounds the significance of the time of the remote trial,and discusses the tool efficiency and value priority of the remote trial,including the value significance of procedural justice,judicial openness,judicial consultation and so on.The second part introduces the application of the extraterritorial remote trial.The innovative model of the integration of information technology and judicial system has been widely used extraterritorial,and it provides reference for the construction of the system in our country by examining and comparing the practical experience of the operation of remote trial in different countries or regions.The third part discusses the current judicial practice in China.Many provinces and cities have carried out different degrees of remote trial of practical exploration,at present,the pilot experiment of remote trial in Zhejiang,Jilin and other places has made good achievements.By analyzing the present situation of the practice of remote trial in our country,this paper studies the realistic predicament and points out the specific problems faced by the remote trial in our country.The fourth part summarizes the above analysis and discussion of remote trial.Drawing lessons from judicial practice in other provinces of China,try to design the development of the remote trial mode in Shanxi,standardize the development path of Shanxi remote trial,and improve the level of judicial trial in Shanxi.
