widening.Whether we can effectively activate the potential of rural economic development is the key to solve the imbalance between urban and rural development and promote rural poverty alleviation and prosperity.In order to activate the economic potential of the countryside,the development of modern agriculture can not be separated from the support of a large amount of funds.How to finance through the existing assets in the countryside is the crux of effectively solving the problem of rural funds.Rural land is one of the most important resources in the countryside.It is an effective way to solve the fund problem in the countryside to use the mortgage of the contractual management right of rural land.However,the provisions of mortgage financing for the contractual management right of rural land are not standardized and perfect in our country’s law,financial policy and supporting mechanism system.It is necessary to further sort out the relevant laws,financial and financial regulations.Only by comprehensively considering and solving the problems of supporting mechanism can we effectively promote the mortgage financing of rural land contractual management right in China.Starting from the historical context of rural land contractual management rights,this paper clarifies the development history of rural land contractual management rights and the future development direction.Mortgage financing of rural land contractual management right will gradually become one of the important means of rural financing in China.It will also be the gradual transformation and innovation of financial institutions to seize the development direction of rural financial market.However,at present,many problems in mortgage financing of rural land contractual management right need to be solved urgently.According to the current situation of rural capital demand in our country,through combing the general situation and research literature of mortgage financing of rural land contractual management right,we can see that most scholars believe that mortgage financing of rural land contractual management right is conducive to promoting the development of rural economy,and it is a convenient policy for the people and the people.In many scholars’ investigation on the practice of mortgage of rural land contractual management right,it is also found that most farmers still hopeto get financial support by means of mortgage of rural land contractual management right.However,in view of the risks,the financial institutions of our country think that the mortgage financing of rural land contractual management right has defects in the legal provisions,and there are many problems in the mortgage evaluation,registration and other supporting mechanisms,so the enthusiasm of developing mortgage financing of rural land contractual management right is not high.However,with the gradual trend of national policies towards rural areas,pilot loans for rural land contractual management rights are in full swing,providing space for financial institutions to gradually involve in mortgage of rural land contractual management rights.In order to improve the law and policy of mortgage financing of rural land contractual management right in China,this paper firstly analyses the current situation of mortgage financing of rural land contractual management right in China,and elaborates the defects and conflicts in laws and regulations.Secondly,it analyses the fact that the principle of wind control of financial institutions in China is contradictory to the mortgage risk of rural land contractual management right.The mortgage value of rural land contractual management right itself is relatively weak,while the financial institutions in China,especially commercial banks,operate on the principle of "three characteristics".The essence of the contradiction between the two is the risk control of financial institutions.Thirdly,it expounds the imperfection of the supporting system of mortgage financing for rural land contractual management rights in practice,such as the imperfection of many supporting mechanisms in the aspects of certificate processing,transaction services and mortgage registration of rural land contractual management rights.In order to solve the above dilemma faced by the mortgage of rural land contractual management right,this paper tries to gain some experience and Enlightenment for the mortgage of rural land contractual management right in China through the analysis of foreign legal and financial system of rural land mortgage.At the same time,combining with the causes of the predicament of mortgage financing of rural land contractual management right in China,this paper puts forward some solutions from the aspects of finance,law and supporting system,in order to solve the crux of mortgage financing of rural land contractual management right,promote the implementation of mortgage financing of rural land contractual management right,effectively solve the rural capital demand and achieve the goal of benefiting the people. |
