The Study On The Right Of Minors To Be Forgotten

With the advent of the era of big data,personal information protection has attracted much attention,and many enterprises will also face problems such as the collection,use,disclosure and transfer of personal information in the process of operation.As personal information is related to the interests of personality and the subject of information rights has property interests,the protection of personal information is particularly important.As an emerging "right" that plays a defensive and remedial role in personal information,the right to be forgotten is generally welcomed in western countries that attach great importance to personal privacy protection and property awareness.Due to the fact that it is a "right" born in the era of big data,there are various opinions on its nature.Therefore,this paper aims to introduce and analyze various theories,and on this basis,make clear that the right to be forgotten is the negative power of personal information right,rather than the right of privacy and general personality.Minors,meanwhile,as a vulnerable groups in social life,its particularity determines their personal information and privacy protection should distinguish somewhat with adults,should be treated differently in the legislation,and in practice to involve the forgotten protection of minors to provide standard guidelines,in order to can ensure the collection,use and disclosure of personal information and transfer of legal,to avoid potential legal risks.
