Since the legislation does not explicitly imply the meaning of the relationship,it does not systematically set the relevant system,and the academic community is also relatively shallow on this research,there are many problems in judicial practice.Therefore,a more in-depth study of the implicated relationship is of great significance.This article takes the implicated relationship as the starting point,and focuses on the conceptual analysis,type construction,value orientation,and institutional dilemma of the implicated relationship,and finally settles on the construction of the implicated relationship and the implicated jurisdiction system.This article hopes to attract more attention from the academic community by ignoring the jade,and propose more good ideas.This article is divided into four chapters.The first chapter mainly clarifies the basic issues of the implicated relationship,including its meaning,type analysis and value considerations.The second chapter is about the institutional considerations related to the implicated relationship,mainly from the common litigation system,the litigation third party system,the counterclaim system,and the implicated relationship in the implicated jurisdiction system,and analyzes the current situation of the system.The third chapter examines the dilemma in the common litigation system,the third-party system,the counterclaim system and the jurisdictional system from the perspective of implicated relationship.The fourth chapter puts forward the rule construction on how to apply the implicature relationship,including the increase of the implicated relationship,the construction of the implicated jurisdiction system and the restriction on the discretionary power of the implicated relationship.
