Research On The Ownership Of Currency Rights

The identification of currency tenure is related to the security of the property of the parties.On the other hand,it is also an important link in the operation of the social economy and the normal trading and circulation.However,the dogmatic 'possession that is all' principle currently adopted in China regulates all currencies,which is obviously unreasonable and remains many drawbacks.According to its characteristics,the vesting of currency rights should be included in the movable property,for which Other countries have legislative provisions and mature jurisprudence.There is no provision in civil law in China.In order to solve the confusion in theory and practice,it is necessary to specialize the currency itself.Based on the legal nature and theoretical basis,this paper draws on the comparative method to analyze the possibility of currency ownership of China in the construction of property rights theory,in order to solve the problem of the ownership of currency of China.
