On The Perfection Of The System Of Internet Judicial Auction

With the continuous improvement of the level of economic development and the popularization of Internet information technology,the form of judicial auction is constantly changing and developing.The emergence of the network judicial auction mode not only relieves the difficult situation of execution,but also greatly reduces the commission cost and improves the efficiency of judicial auction.In recent years,local courts have reformed traditional judicial auctions through the use of online platforms,which has also produced different types of online judicial auctions,but among the many models,the most representative is the Taobao auction model.The bidder can participate in the judicial auction through the Ali auction platform in Taobao.Taobao auction is a typical form of court independent judicial auction.It was first introduced by Zhejiang Province.It has solved to a large extent the problems existing in traditional judicial auctions in terms of the number of bidders,the auction cycle,and the disclosure of information.It provides a good reference for China's judicial auction reform.However,Taobao auction mode,as a new thing,still needs to be improved in many aspects,need to deepen reform continuously,sum up experience.This article aims to study and analyze the whole system of online judicial auction,focus on the legal issues involved in Taobao auction model,and compare it with other online judicial auction models.While highlighting its advantages,we find out the problems that have arisen injudicial practice,and put forward corresponding suggestions to improve it,so that Taobao auctions can give full play to their own value,and ensure the integrity and fairness of the auction process while improving the efficiency of judicial auctions.We will better promote the solution of the problem of "difficulties in implementation" in our country.This article consists of four parts.The first part introduces the connotation and evolution of online judicial auction,and the research on Taobao auction model should be based on the system of online judicial auction.Through the analysis of the basic meaning,the development course,the application situation abroad and the different models of online judicial auction,we can understand the whole system of online judicial auction.The second part is to analyze the Taobao auction model,compare the differences between it and other types of online judicial auction,and discuss the relevant legal issues.The third part mainly discusses the problems existing in the network judicial auction in China and analyzes the problems in the operation mechanism,supervision mechanism and relief mechanism of the network judicial auction.In the last part,the author puts forward some suggestions on the problems existing in the network judicial auction system,so that the network judicial auction system can be perfected and the value can be maximized.
