Legislative Defects And Perfection Of Money Laundering Crime In China

Since the reform and opening up,with the rapid development of China's economy,the rapid advancement of science and technology,the increasing frequency of foreign trade and the intensification of money laundering,money laundering criminals use highly intelligent computer systems to constantly renovate money laundering methods and diversify types,resulting in increasingly prominent harmfulness.International organizations have established a series of legislation and related systems.To form a more rigorous prevention and control system.The Criminal Law of our country stipulates the crime of money laundering.And through a series of amendments to repair and improve,although some results have been achieved,but still can not effectively prevent and control such crimes,it needs to be improved in a timely manner.To coordinate the crime of money laundering and other crimes related to money laundering within the criminal law system and the crime of money laundering outside the criminal law with the anti-money laundering law and related laws and regulations.This paper mainly discusses the legislative status of money laundering crime in China,expounds the legislative evolution and legislative characteristics of money laundering crime in China,points out the legislative defects of money laundering crime in China,the most obvious of which is the confusion of the legislative system of "tripartite force of three crimes" caused by the long-term legislative model of minor repairs and which ones are missing,followed by the crime of money laundering and the allocation of penalties.On the one hand,the author emphasizes the shortcomings of narrow scope of upstream crime and low statutory penalty of money laundering crime.In view of the above three kinds of shortcomings,the author proposes one by one amending countermeasures,coordinating the legislation system of money laundering crime,repairing the establishment of counts of money laundering crime and balancing the allocation of criminal law of money laundering crime,so as to make the legislation of money laundering crime in the Criminal Law of our country...
