The Dilemma And Solution Of Network Virtual Property Inheritance

Today's society is a digital era,and the Internet has affected our lives all the time.The Internet has brought a lot of conveniences and benefits to people's lives.Of course,there are also some social problems that need to be solved.Although China's Article 127 of the General Principles of Civil Law promulgated in 2017 included the network virtual property in the protection of civil law,China's first virtual recognition and protection of network virtual property was legally recognized.However,there are only provisions of this law,and there are no specific laws and regulations for the definition,characteristics,legal attributes and inheritance of the network virtual property and its solutions.These problems are all that our legislature needs to consider and gradually solve.This article will be divided into five chapters.The first chapter is mainly to ask questions and analyze their problems.The second chapter mainly analyzes the basic theory of network virtual property.It will be discussed from the following modules to analyze the definition,characteristics,legal attributes of network virtual property and the necessity and feasibility analysis of network virtual property inheritance.Because China has more imperfections in the virtual property of the network and its inheritance,all aspects need to be improved.Therefore,China needs to learn from the relevant regulations of developed countries.The United States,South Korea,Japan,and Germany have always been in the world's leading position in the Internet.These countries also initially encountered problems in order to network virtual property and its inheritance.To this end,in response to the problems that have arisen,combined with the actual situation of the country,combined with national conditions.Relevant specific laws and regulations.China can learn from the advanced practices of these developed countries,and specifically combine the predicaments of China's emergence,and its targeted learning and reference.The fourth chapter will elaborate on the dilemma of China's network virtual property inheritance,including the problems in related laws,the unfairness and irrationality of network service agreements signed by network operators and users,and the inheritance and privacy of network virtualproperty.There is a conflict in power,and China lacks a value assessment standard.The fifth chapter mainly focuses on the problems existing in the fourth chapter and proposes corresponding solutions.
