Research On Peng Zhen's Constitutional Supervision Thought

In order to improve the understanding of the Constitution and increase the implementation of the Constitution and the supervision of the Constitution,the report of the 19 th National Congress of the Communist Party of China clearly stated that "the constitutional implementation and supervision should be strengthened,the constitutional review work should be promoted,and the constitutional authority should be safeguarded."(1)In the fifth constitutional amendment in 2018,the Constitution and Law Committee officially became one of the special committees of the National People's Congress.(2)At the same time,the constitutional oath system was also included in the constitutional provisions of our country,and the words of the constitutional authority were clearly stated in the oath.As the main member of the party's second-generation central leadership group,Peng Zhen has served as the vice chairman of the Fifth National People's Congress Standing Committee,the deputy director of the Constitutional Amendment Committee,and the chairman of the Sixth National People's Congress Standing Committee.He has long presided over various political and legal work and legal system construction work.He has mastered solid constitutional implementation and supervision theory in practice,worked hard to promote the work related to constitutional supervision,and made outstanding contributions to the establishment and improvement of the constitutional supervision system.At the same time,the development process of Peng Zhen's constitutional supervision thought also reflects the background and process of the establishment of China's constitutional supervision system.Today,in the new era,I will re-read Peng Zhen and study his consideration of constitutional supervision,related discourse,and activities in the practice of focusing on constitutional supervision.This is to learn and understand the more socialist rule of law thoughts formed by General Secretary Xi in the new era,carry out the guiding ideology of governing the country according to the constitution as the "class",and understand,analyze and improve China's current the constitutional supervision system and the promotion of constitutional review work are of great significance.This paper mainly uses literature analysis,historical analysis,Comparative analysis and value analysis methods to understand and sort out the formation and development of each stage of Peng Zhen's constitutional supervision thought and its construction and practice of constitutional supervision system.This paper analyzes Peng Zhen's historical contribution to the constitutional supervision system and the Chinese characteristics reflected by the foreign model.Combined with the current background of China's implementation and supervision of the Constitution,it takes history as a guide,promotes the constitutional review work in an orderly manner,and maintains the constitutional authority,and establish a constitutional belief.This article is divided into four parts: The first part discusses the connotation of Peng Zhen's constitutional supervision thought.At the beginning,it briefly introduces the concept of Peng Zhen's constitutional supervision thought.After that,it analyzes the formation of Peng Zhen's constitutional supervision thought,which mainly has two aspects: theoretical foundation and practical foundation.On this basis,it summarizes the thoughts of various stages of birth,germination,brewing and development.The second part summarizes the main contents of Peng Zhen's constitutional supervision thought,including the reasons for establishing the constitutional supervision system,what kind of supervision mode is established,and how to properly promote constitutional supervision work in China.In the third part,on the basis of a brief introduction to the mainstream constitutional supervision model of foreign countries,the author compares the Chinese characteristics reflected by Peng Zhen's constitutional supervision thought and the historical value of his thoughts on China's legal construction at that time.The fourth partcombines the development direction of the rule of law in China in the new era and the relevant requirements of the constitutional review work.Under the enlightenment and guidance of Peng Zhen's constitutional supervision thought,at the same time,compare and draw on the regulations of relevant foreign systems.we will discuss how to steadily advance our country's constitutional work.
