Research On Liabi Lity Identification Of Non-motor Vehicle Traffic Accidents

Along with the reform and development since the rapid economic and socialdevelopment and improve people's living standards,China's city construction to further accelerate the process,the city continues to expand the scale of road traffic infrastructure and people's travel conditions have been continuously improved.In this process,the rapid development of new types of non-motor vehicles led to a series of management problems,such as non-motor vehicles internal management confusion,non-motor vehicles exceed the standard rampant and traffic illegal behavior everywhere.Non-motor vehicle traffic accidents increase year by year,which obviously led to the personal and property damage.In the paper,the author has made extensive research on the development demand,traffic violation,traffic control and the related standards,laws and regulations concerning the non-motor vehicle industry,the frequent occurrence of non-motor vehicle traffic accidents as the research background,Nankai District of our city as the main research model.On this basis,taking the field observation and case analysis as the research methods,the paper analyzes the present situation and existing problems of the identification of non-motor vehicle attributes in current laws,the traffic accident liability principle between non-motor vehicle and motor vehicle,and the subject of compensation,learns from the advanced concepts of foreign legislation,then puts forward some suggestions from four aspects:improving non-motor vehicle qualitative standard,management mechanism,traffic accident attribution method,and law enforcement countermeasures according to the analysis and results above.
