With the development of science and technology,countries have increasingly increased the intensity of development and utilization of marine resources,and expanded their activities to areas outside the jurisdiction of the state.The pressures on the outer seas are increasing.If they are ignored,they will not be able to provide human resources.Therefore,the conservation and sustainable use of marine biodiversity in areas beyond national jurisdiction faces enormous challenges.However,the current legal framework is not enough to regulate core issues of this topic,and international or regional conventions such as the UNCLOS and the CBD do not clearly define this.Therefore,in order to compensate for the lack of an international legal system for the conservation and use of biodiversity in areas beyond national jurisdiction,the UN General Assembly mandated a working group with the aim to elaborate a new protocol,in order to address the conservation and sustainable use of biodiversity beyond national jurisdiction,the agreement is BBNJ.However,because of the differences in national conditions and the differences in interest needs,they have different opinions on the agreements and are still in the process of negotiation.It is foreseeable that the conservation and sustainable use of marine biodiversity beyond national jurisdiction is a hot issue in international ocean affairs for a period of time to come.This paper is divided into four chapters to study and analyze the issue of biodiversity conservation in areas beyond national jurisdiction.The foreword mainly introduces the changes in the concept and scope of sea areas beyond national jurisdiction.The first chapter introduces the general situation of the legal system outside the national jurisdiction and the biodiversity protection system of the offshore waters.The second chapter mainly clarifies the problems existing in the existing framework through the combing of the legal framework for the protection of biodiversity in areas beyond national jurisdiction.The third chapter is the new progress of the legal system for biodiversity protection in the sea areas under national jurisdiction,which is demonstrated from three aspects:global,regional and international organizations.The fourth chapter explores the impact of new developments in marine biodiversity protection systems beyond national jurisdiction on China.
