Probe Into The Construction Mode Of Program Supervisor System

Under the premise of similar systems between Germany and Japan,Taiwan Province of China has established a system of program supervisors in combination with legal practice in the region,which is detailed in the newly-developed Family Incident Law and related legal docunents.The meaning of "family incidents" refers to incidents involving identity or property relationship disputes between members with family relationships due to conflicts of interest such as emotions.The so-called program supervisor is actually a professional procedural assistant who is selected by the non-procedural ability involved in the case in the process of family disputes,to help non-professionals to participate in the proceedings,and to assist the judges in fair trials,especially in the maintenance of ninors.This system is often used in people's interest cases.The program supervisor is applicable to those who protect all non-litigation capabilities.This article focuses on how the program supervisor functions in falily matters involving the interests of minors.This paper analyzes the content and role design of similar systems in foreign countries and the system of supervisors in Taiwan,and combines the existing civil trial system in mainland China to diagnose the defects of family affairs.It is intended to suggest the construction of program supervision in mainland China.People system.Through the basic introduction to the program supervisor system,the article mainly discusses the necessity,feasibility and concrete construction design of the program supervisor system in the form of comparative law and case analysis.Based on the imperfect agency and guardianship system in the current civil entity and procedural law,there is a predicament of protection of minors' interests in the legislative and practical aspects,and the system of procedure supervisor has its necessity.Various mature theories of the protection of minors and the reform of family trials that have been carried out provide theoretical and practical foundations for the establishment of process supervisors.Finally,the article focuses on the specific construction of the program supervisor,from the legislative model,operating procedures,scope of application and object,election exit,rights compensation and other specific legislative matters and supporting security system,I hope it can help to create a systm of program supervisors in the mainland.
