Further Research On Forceful Harassment And Humiliation Crimes

The Criminal Law Amendment(9)amended the original crime of forced assault and insulting women,and the judicial interpretation of the latter two high-level"Supplementary Offences(6)" determined that the crime was "mandatory and insulting."However,this summary does not conform to the scientific principle of criminal law crimes.If it can be changed to forced indecent assault" and forced insult to women",it may be more in line with the legislative intent of criminal law and make the crime more scientific.This is because the current legislation does not duplicate the provisions of "forced indecency" and "forced insult".In addition,the denial of compulsory defamation and insult crimes is a tendency crime.One is conducive to distinguishing between forced defamation and forced insult,and the other is conducive to distinguishing the essential difference and difference between forced defamation,insult,and Korean insult.This article begins with the revision of the criminal law provisions,and combs and analyzes the connotation of the crime from the aspects of understanding and application,and then compares the crime of forced indecency and insult with other similar crimes in detail,and draws on foreign relevant legislation.A systematic study on the protection of men' s sexual rights was conducted,and finally legislative proposals were put forward to criminalize forced insults to men and insulting children,so as to solve the relevant practical problems in criminal law regulations and judicial practice.
