Study Of Security Obligation Of The Property Service Enterprise

With the reform and opening up and social development,China's real estate industry has made unprecedented progress.The traditional housing management mode is gradually replaced by the modem property service mode.Property service enterprises provide services for the owners,at the same time,the contradictions between the two sides often occur,one of which is the responsibility of security obligations.Based on the relevant theories and judicial cases in the trial practice,this paper studies the security obligations of property service enterprises in order to promote the unification of the judgment criteria and solve social contradictions.In addition to the introduction,this article includes four parts.The first part mainly expounds the basic concepts of property and security obligations,and clarifies the theoretical and legal basis for property service enterprises to undertake security obligations.The second part discusses that the security obligation of the property service enterprises is a kind of competition obligation with both legal obligation and contractual obligation,and expounds its contents.The third part introduces that the liability of property service enterprises for breach of security obligations is the concurrent liability of tort liability and breach of contract liability,and the victim can choose one to claim.The fourth part mainly puts forward several suggestions on perfecting the security obligation system of property service enterprises.It is hoped that through the discussion of the above problems,it will be helpful to improve the security obligation system of property service enterprises and reduce the disputes arising from it.
