Chinese Patent Infringement Detection Based On Patent Infringement Tree

Patent information is one of the important competitive intelligence resources,which can effectively protect the technical rights of enterprises or individuals,but also contains a large amount of technical information.By fully exploiting and utilizing patent information,it is possible to understand the development trend of technology and obtain patent intelligence.With the increasing competition in the market,people's awareness of intellectual property protection has been continuously strengthened,but the patent infringement cases caused by this are not uncommon.Patent lawsuits caused by patent infringement are likely to infringe on the legitimate patent rights of enterprises or individuals,and bring certain economic losses.Therefore,as an effective way to avoid infringement risk in advance,patent infringement detection has attracted more and more attention.However,patent information usually has a variety of structures and large data scale which brings great difficulties to infringement detection.At present,the research on patent infringement detection is still in a relatively single or theoretical stage,which cannot meet the increasing demand for infringement detection.This paper comprehensively consider various patent information related to patent infringement,make full use of the information available in the patent literature,and display the hierarchical relationship among various elements of infringement in the form of a tree structure,so as to establish a patent infringement tree.It also calculates the patent infringement tree layer by layer.From the two aspects of the similarity of patent and the possibility of infringement,the patent infringement is analyzed from multiple angles: one-to-one patent,one-to-many patent,many-to-many patent,enterprise and enterprise.The patent infringement detection is raised from a single patent level to the enterprise perspective,and the utilization of patent information is increased,thereby improving the practicability and comprehensiveness of infringement detection.Finally,through empirical analysis,the actual enterprise data is used to verify the feasibility of the proposed method,so that patent infringement detection can play a role in reality.
