| The development of a country’s law can not be separated from the transplantation of law.A comparative study of the laws of other countries is of great significance to the improvement of our country’s legal system.Belarus and China have different legal systems.On the basis of inheriting the laws of the Roman Empire,Belarus’ s current testamentary succession system has absorbed and developed a large number of modern international norms.Comparing the different provisions of China and Belarus on testamentary succession system,and putting the inheritance system under different legal cultures,we can produce the perfect legislation of China.New ways of thinking.By comparing the inheritance legal systems of China and Belarus objectively,the author realizes that there are some differences in the testamentary inheritance legal systems between China and Belarus.At the same time,the existing legislation of succession in China and Belarus is unreasonable and needs further improvement.In the distribution of family property,testamentary inheritance is the best way to embody the testator’s freedom of will.However,the form of making a testament in China is too simple to meet the needs of social development.In addition,the two countries have different provisions on testamentary witness,mandatory portion and formal elements of inheritance.Through comparative analysis,this paper aims to provide reference for the formulation of the Chinese Code. |
