Research On Issues Related To Gang-related Organized Crime

Our country "anti-triad putting the" specific work has been carried out for many years,in order to adapt to the change of the police organization crime,criminal regulations about black evil forces crime,judicial interpretation and criminal policy innovation continuously.The purpose of this paper is to deeply analyze the police organized crime development situation and the reality of the situation facing,combined with the new criminal policy,explores the existing problems and puts forward the method to solve the problem,in order to completely remove the black evil forces organizations(also called "police organization").This paper consists of introduction,body,and conclusion of three parts.The introduction part has been clear about the category of the police organization is the underworld property organization and evil forces,and briefly introduces the domestic and foreign scholars study of police organization.The present in order to completely remove the black evil forces,the police organized crime legislation perfect must be regarded.The body is divided into four chapters.The first chapter is a major basic overview of the organization.This chapter is divided into two parts,the first part is by definition,compare different criminal organizations to recognize the police organization's category and attribute;The second part introduces the existing police organized crime related criminal policy and criminal law norms,focus on organizing,leading,and to participate in the underworld gangs(hereinafter referred to as the underworld gangs)the crime of common and evil forces.The second chapter "soft violence" means such crimes as the research object,this paper introduces the current new germination of police organization form and the development trend of the future,namely from the "violence" basis and exist alone pure organization "soft violence"."Soft violence" remaining omissions in criminal law,in order to curb the new police organization,it is necessary on the root punishment of organizing,leading,and participate in the behavior of the police organization.The third chapter carries on the second chapter to the punishment on the legislation organizing,leading,and participate in the behavior of the police organization to continue to discuss,confirmed by "evil forces" into sin.This clause presents the view of the current scholars,denied "evil forces" independent set up into a sin,for the evil forces into the underworld gangs,punish in order to achieve organization,leadership,and actively participate in the purpose of the behavior of the evil forces.The fourth chapter,combined with criminal policy and criminal code,analyzes the current definition of triad organizations,the significance of the existence of triad organized crime,and works in concert with the previous two chapters,proposing to improve the regulation measures of triad organizations,recognizing that the inclusion of evil forces into the category of triad organizations is conducive to the eradication of evil forces.The conclusion further summarizes the author's views.To root out the evil forces thoroughly,it is necessary to root out the behavior of the organization,leadership and active participation of the evil forces from the root.
