With the progress of society,the legal consciousness of citizens is constantly improving,and the legislation of the country is also constantly improved on the basis of the original.The Criminal Law Amendment(8)added the crime of dangerous driving,and the Criminal Law Amendment(9)increased the type of behavior of dangerous driving to four types: drunken driving,chasing driving,overspeeding and illegal transport of dangerous goods.One of the most common is the crime of drunken dangerous driving.But since its implementation,there exists the inconsistent sentencing in the trial process,which leads to the unbalanced sentencing of dangerous driving crime in judicial practice.The sentencing of the crime is directly related to the social and legal effectiveness of the crime of dangerous driving.In this paper,200drunk-type dangerous driving cases,which have been tried and closed by various grass-roots courts in Xinjiang,are analyzed,and the problems of the crime in sentencing are investigated.In the first part,the author summarizes and summarizes the main circumstances of sentencing in the case of drunken dangerous driving,and clarifies the factors that the judge should consider in the trial of the drunk dangerous driving crime,and the main circumstances of sentencing in the case of drunken dangerous driving are summarized and summarized in the first part.Summarize the sentencing trend of drunken dangerous driving cases.In the second part,the author focuses on the problems existing in the sentencing of the drunk-type dangerous driving crime in the judicial practice.The third part makes a detailed analysis of the imbalance of sentencing of the crime,and puts forward some suggestions to solve these problems.
