| The rapid development of auto-driving vehicles needs the protection of the relevant legal system.At present,the related research in our country is still in the initial stage,and it is urgent to strengthen the study of auto-driving vehicle legal regulation.We first clarified the concept and characteristics of self-driving cars,combined with government function theory,public interest theory,administrative rule of law theory and other related theories,carefully analyzed the potential social risks of self-driving cars,and revealed the dilemma of the legal regulation of self-driving cars.On the one hand,the current regulation concept,the regulation method and the road traffic liability determination rules can not meet the regulatory needs of self-driving vehicles.On the other hand,it has not established new regulatory concepts and established regulations on self-driving vehicles and related traffic liability rules.At the same time,there are many problems in the road test system of auto-driving cars.These problems will lead to the regulation of auto-driving cars.In order to better deal with the huge social risks caused by self-driving vehicles,it is necessary to build up the legal regulation system of self-driving vehicles.Under the guidance of the concept of pre-prevention and people-oriented cooperation,we will establish a regulatory model for the cooperation between government and enterprises in autonomous driving vehicles,and establish a scientific road test system and a reasonable and strict market access and exit mechanism at the legal level.It is also necessary to clarify the accident liability system after the traffic accident of the auto-driving vehicle.Of course,the regulation of auto-driving vehicles needs more support from laws and regulations.Relevant laws and regulations need to be revised to determine the legitimacy status of auto-driving vehicles and find a balance between promoting the development of the auto-driving industry and protecting public safety. |
