Research On Legal Attributes Of Network Account Transfer

Under the support of modern science and technology,the Internet-based service industry is increasing day by day,resulting in an unprecedented number of network users.Network users register a variety of network accounts to obtain network services.In the process of using network accounts,network users have invested a lot of energy and financial resources,making the value of online accounts increasingly prominent,and the property value of online accounts is coming.The more attention it receives from society.As the circulation of online accounts has become more frequent,the online account trading platform has been born,and the online account trading market has arisen.However,the network service provider as the controller of the network account does not allow the network user to transfer the network account.The problem of prohibiting the transfer of the network account has caused great controversy in the theoretical circle.The legal attributes of online accounts have not yet been determined,making it difficult to find appropriate legal norms to regulate the transfer of online accounts.This article will be discussed in four parts to try to solve the above problems.First of all,this paper briefly discusses the transfer of online accounts.This paper clarifies the objects and related subjects of the transfer of online accounts,and summarizes the concepts and types of objects transferred by online accounts.It also proposes the dilemma of online account transfer,that is,the network service provider restricts the transfer of network accounts and the legal attributes of online accounts is not clear,paving the way for the legal attributes of online accounts and the evaluation of restrictions on online account transfer.Secondly,this paper discusses the legal attributes of the subject matter of the online account transfer.This paper summarizes the characteristics of the network account,on this basis,reviews the theoretical doctrines of the network virtual property,and enhances the comprehensive understanding of the legal attributes of the online account;and further expands from the category of academic objects,the attributes of the network account An analysis is made to determine the benefits of the attributes of the network account to demonstrate that the transfer of the network account can be adjusted by the property law.Again,this article dialectically analyzes the restrictions on the transfer of online accounts.Under the premise of determining the types of property rights of the network accounts transferred by the network account,the legality of restricting the terms of the network account transfer is clarified,and the irrationality of the terms of the online account transfer is prohibited.It is recommended that the network account service provider release the network account.transfer.Finally,this paper attempts to improve the relevant system of network account transfer.Inorder to make the transfer behavior of the online account orderly,according to the property value of the online account or the influence on other people,this paper proposes three modes of property rights change: the single registration requirement mode,the dual registration requirement mode and the registration confrontation.Mode;In order to cooperate with the implementation of three modes of property rights change,this paper attempts to construct a network account transfer mechanism to ensure the smooth progress of online account transactions and promote the healthy development of the network economy.
