The Research On The Safeguard Mechanism Of The Witness To Testify In Court

Criminal witness appearing in court has always been an important part of court proceedings,and has irreplaceable value for finding out cases.Only the criminal witnesses appear in court to testify,the procedure of the testimony of the trial can be substantial,and the reliability of the testimony of the witness can be effectively guaranteed,and the fairness of the procedure and the entity can be realized.But all the time,the criminal witness in our country has been confronted with the issue of the criminal witness' s refusal to testify in court,and the low rate of witness appearing in court has become an old and difficult problem in the criminal judicial procedure.After the amendment of the criminal procedure law,the content of the witnesses to testify in court has been greatly perfected.However,since the implementation of the law,the issue of the rate of witness appearing in court has not been effectively alleviated.It can be seen that the court testimony system that directly affects the appearance of criminal witnesses is not perfect,and it is still worth further improvement.Therefore,based on this idea,this paper tries to make a systematic analysis of the criminal witness' s testifying in court.First,we review the theoretical basis of the guarantee system of witness appearing in court,and then make a realistic view of the system of witness appearing in court,analyze the present situation of the criminal witness in our country and the existing problems in the system of the appearance of the court.Then,it introduces the security system of the criminal witness appearing in court in the outside world,analyzes the places that can be used for reference,and gives his own views on the perfection of the system of witness appearing in court.
