Research On The System Of Donating Legal Person’s Property To Religious Places In China

As the economic basis of religious activities,the protection and management of religious property will affect all aspects of the daily affairs of religious activities.However,due to the lack of clear civil subject status of religious activity sites in China for a long time,the property system related to religious activity sites either lacks supporting property norms,or the prescribed property system cannot be implemented due to various reasons.As a result,a series of religious property problems,such as commercialization of venues for religious activities,infringement of property rights and interests of venues for religious activities but difficulties in relief,have emerged.Therefore,after "General Provisions of the Civil Law of the People’s Republic of China" has initially solved the problem of legal person qualification of religious activity sites,the next most important thing to be solved is how to comprehensively construct the property system of legal person of religious activity sites in China.This paper hope through to the religious activity places in our country theory and the analysis of the status quo of the legal property system of donors,found the religious activity places in property management and protection of the problems existing in the process,through the analysis of causes of the problem and the combination of the religious activity places property system outside of our experience and enlightenment,and search for perfect our way out of the religious activity places donations legal property system.In order to contribute to the improvement of the legal person property system for religious activities in China.In addition to the introduction and conclusion,this paper is mainly divided into four parts.Chapter one: conceptual operationalization,which clarifies the connotation of the religious activity sites studied in this paper and the understanding of the donation legal person and its property system of the religious activity sites,provides a theoretical foundation for the following part.Chapter two: problem analysis,starting from the status quo of the legal persons donating places for religious activities,and combining with practical cases,it emphatically explains the problems existing in the process of property management and protection of the legal persons donating places for religious activities in China,and analyzes the causes.Chapter three: through the overseas mirror,the paper analyzes the relevant regulations and practices of Germany,Japan,Britain and the United States on the property of religious activity sites,and provides experience and inspiration for the legal person property system of religious activity sites in China.Chapter four: research Suggestions.Through the above analysis,the author tries to put forward countermeasures and Suggestions to improve the legal person of the site of religious activities in China from the four aspects of unifying the premise of the system,determining the attribution method,exploring the characteristic management mode,and implementing and improving the supervision mechanism.
