Research On The Standardization System Of Road Property Damage Compensation

The standardization of compensation for damages of road production is one of the subjects concerned by traffic law,and an important part of road production protection.The system of compensation for damages of road production provides guarantee for protecting the integrity of road production and realizing people's right of passage.It is also of practical significance to promote the healthy development of the transportation industry and the strategic process of ruling roads by law,so as to promote the development of other industries and the realization of the goal of building a traffic power.This paper aims to study the standardization system of compensation for damage caused by road production and relevant policies and regulations,take the compensation for damage caused by road production as the research object,and on the basis of combing the existing theories and practices,put forward some ideas to improve the standardization system of compensation for damage caused by road production.From the perspective of economic law,in the context of comprehensive law enforcement reform of transportation,this paper analyzes the ways to improve the compensation mechanism for road production damage and the standardization system.Taking the advantages of the reform to make up for the shortcomings of the current situation and integrating the experience in the standardized management of road production compensation,this paper puts forward some suggestions to improve the standardized system of road production damage compensation,improving the protection efficiency of road production and promoting the healthy development of road industry.The research content of this paper is divided into four parts: The first part clarifies the theories related to the standardization system of road production damage compensation to lay a good theoretical foundation for this paper;The second part,according to the three types of legal liability under the standardization law,puts forward the problems existing in the practice of compensation for road production damage and analyzes them from the three aspects of the formulation,implementation and supervision of the compensation standard for road production damage.The third part,combined with the existing road production damage compensation standardization laws and regulations in some provinces and cities in China,as well as other measures in the comprehensive law enforcement reform of road administration,integrate and learn from the development experience;The fourth part,in view of the problems existing in the application of the standardized system of road production damage compensation,puts forward the corresponding feasible Suggestions from the aspects of the perfection of the standard of road production damage compensation,the standardization of the implementation process,and the richness and diversity of the means of supervision.The perfection of the standard system of compensation for damages of highway and road production is inseparable from the reform background of economic environment and transportation industry.It is necessary to promote the market-oriented development of highway maintenance,change the way of claim for road production damage,improve the level of claim for damage while improving the basis of compensation,and strictly standardize the legal liability of compensation system to realize reasonable compensation for road production damage and ensure the healthy development of highway transportation industry.
