Research On The Execution Mechanism Of Network Investigation And Control

The execution mechanism of network investigation and control is one important outcome of the executive information construction,it is a new beginning of civil execution and makes the civil execution mechanism change from manual model to informational mode,and it is useful to solve the problem of difficult execution.At present,the Supreme People's Court sets up a system platform and use network to query and control property information,it has made up some defects of the traditional civil execution mechanism,such as low efficiency,high cost and big difficulty,and it has obtained good execution effects.But,how to construction this mechanism is a systemic and complex project,it has some problems in both theoretical and practical aspects.What problems it has and how to solve these problems is the emphasis and difficulty of this thesis.Therefor this thesis puts forward some suggestions in three aspects.Firstly,for comprehensive consideration of executable requirements,courts should establish“total to total” investigation and control of network execution system;secondly,formulate unified high-level provisions,standardize the rights and obligations of assist execution units to assist in enforcement;thirdly,establish supporting property register system,and strengthen network information security.This thesis is composed of five chapters: the first part introduces the background,purpose and innovation of the thesis;the second chapter expounds the connotation,course of development and relations with related systems;the third chapter analyses the operating principles and the function,which is the important innovation of this thesis,it establishes the direction for the thesis and provides scientific guidance for how to establish this mechanism;the fourth chapter is about the status and problems of the mechanism,through the analysis of the present situation,the existing problems and the causes of the problems are pointed out;on the basis of the analysis,the fifth chapter put forward some suggestions from three aspects of system design,system regulation and supporting measures.This thesis is a small contribution to perfect and develop this mechanism and it is useful to solve the problem of difficult execution.
