Research On The Integrity Proof Of Electronic Evidence

Since the Criminal Procedure Law,which was implemented in 2013,has officially incorporated electronic data into legal evidence,electronic data has been used more and more widely in criminal proceedings in China.In China,there have been more than 36,000 criminal cases related to electronic data since 2013,and it is showing a trend of increasing year by year.In the case of the increasing use of electronic data,there are more and more problems.And with the advancement of information technology,the Internet and cloud computing have occupied every corner of people's lives.The problems faced by electronic data in the context of cloud data and big data are even more severe.As a problem that electronic data integrity can't be avoided in the process of collecting,extracting and transferring electronic data,it has gradually exposed some problems due to the shortage of new technologies and legal regulations in the new era.In addition to the introduction and conclusion,the full text is divided into the following four parts to study the issue of electronic data integrity:The first part is an overview of the integrity of electronic data.This part first summarizes the different definitions of electronic data integrity in the current academic circles,and abstracts the concept of electronic data integrity.Secondly,it discusses the connotation of electronic data integrity,the difference between other concepts and the meaning of electronic data integrity.The second part describes how electronic data integrity is currently proven in criminal proceedings.This part discusses the proof mechanism of electronic data integrity from three aspects: the proof content of electronic data integrity,the method of proof and the display of electronic data.The third part is the current problem of electronic data integrity.This part is based on the proof mechanism of the current electronic data integrity,and discusses the problems existing in the current electronic data integrity certification mechanism collection and extraction process,custody process and display.The fourth part mainly focuses on the technical problems and legal regulation gaps in the third part of the electronic data integrity certification,and proposes solutions.It intends to solve the problems in the electronic data integrity certification mechanism to form complete electronic data.The construction scheme of the integrity certification mechanism.
