Research On The Mosuo's Marriage And Family Customary Law

Mosuo People who lives near the Lugu Lake is getting the attention from more and more people,because of their particular Walking Marriage.In recent years,with the influence of the tourism in the Lugu Lake,Mosuo's traditional marriage and family habits is changing.We choose three villages with different economic development levels on the fieldwork,to research the Walking Marriage and the construction in Mosuo's family with the changing of time.This paper discussed the relationship between the habits and the Common Law,claimed the Walking Marriages and their matrilineal family construction should classified into the category of the Marriage and Family Customary Law.And then,introduced Mosuo's Marriage and Family Customary Law from their kinship terminology,their way to get married,their family relationship,Combined the specific content of the interview we finished in the three findings,summarized three samples of Mosuo's Marriage and Family Customary law with the change of time.According to the work we have done,from the perspective of the relationship between the social change and law development,we think the national will,the tourism economy and the population flow gives much change to Mosuo.In addition,putted forward some thinkings about the change of the Mosuo Marriage and Family Customary Law,gived some advices about the existing law should pay more attention to the position of the common law.
