Divorce has become a common phenomenon in our society.In divorce disputes,in addition to the relationship between husband and wife and the custody of children,there is also a focus on the distribution of joint property between husband and wife.Considering the distribution of husband and wife's common property,we should not only divide the husband and wife equally,but should try to achieve the fair distribution of husband and wife under the guidance of fair rules.The party who raises a child after divorce shall take due care of it.The party who is at fault during marriage shall be punished.For a party who is unable to live,it should be tilted in the distribution of property.Those who have made a significant contribution to family life should be encouraged.China's society is composed of thousands of families,in divorce to achieve fair division of property,not only let a family satisfaction,but also conducive to the harmony of the whole society.Therefore,in dealing with such disputes,in addition to relying on the wisdom of legal staff,should also have a sound system as a guide.In this paper,the evolution of China's husband and wife property system as a starting point,elaborated on China's current husband and wife property distribution system.And the advantages and disadvantages of the system are carefully considered.Then take the advanced experience of developed countries and regions as a reference,finally for our country's current divorce property distribution system to make their own suggestions.Hope to make their own contribution to the modification and improvement of the property distribution system of husband and wife in our country,with a view to in judicial practice,let ten million families feel the justice and love of the law,promote social harmony and justice.
