Our country in the new revision of the "Criminal Procedure Law" in People's Republic of China for the first time clearly stipulated that the police have the obligation to testify in court,origin from the police witness system,through analysis of the meaning of the system,and then explores the law in China in the process of the mission and legislative intent.For our police to testify the quantity and quality compared with the situation there is a big gap between the countries of Anglo American law system,the right,from the police and witnesses alleged hostage to the ordinary witness exercise,illegal evidence and hearsay evidence rule,rationality and necessity of police witness system.It can be said that the system of police testifying in court is the necessary condition to carry out the principle of direct verbal evidence,and it is also the necessary requirement to maintain the justice and improve the efficiency of litigation.Based on the on-the-spot investigation,the police visited,starting from their own point of view,the system of legislation is not perfect,the police in consciousness is not strong,ideological conflict,the relationship between police and procuratorate and other aspects,carried out in-depth analysis of the system.The author puts forward some opinions on the identity,obligation,the scope of testimony and the measures of compensation for the police to appear in court.It is hoped that the system will be further improved so as to meet the social reality and the current judicial system...
