Family Doctor Service Contract Study

The service of family doctors is the main measure for promoting classification medical treatment and rationally allocating medical resources in recent years in China.After many trials,multiple departments of the State Council officially issued a document on May 25,2016 to promote family doctor signing service.As the legal basis for the operation of the standard family doctor service,the "Doctor Family Service Contract" is unique.The rights and obligations of family doctors in service contracts and the positioning of government and third party roles in contracts are controversial.In the guidance issued by local governments and in the service model of family doctors,the norms are still relatively simple and even conflict with each other,and local practices are inconsistent.This article proceeds from the problems in the family doctor's service contract signing practice and legal regulations,rationalizes the rights and obligations of each subject in the family doctor service contract,and establishes the relevant legal system and dispute resolution method for the family doctor service contract.The first chapter points out that the practice way of family doctor service is signing contract.This is the legal requirement of family doctor's service guarantee.It summarizes the signing mechanism of family doctor and analyzes the attributes and characteristics of family doctor service contract.The second chapter analyzes the relationship between rights and obligations of family doctors' service contract subjects,focusing on family doctors' duty of diagnosis and treatment,contracting residents' right to cancel contract,government agencies' right to audit and other medical institutions' right of diagnosis and treatment.It is the final family doctor's service contract legislation and dispute resolution.Lay the theoretical foundation.The third chapter summarizes the current problems faced by the family doctor service system in China from the perspective of practice.It mainly analyzes the problems existing in the legal norms and contracting methods from the perspectives of the current family doctor service system and family doctor service contract practice.Chapter IV establishes the family doctor service contract system.The family doctor service legislation should form a legal norm system that matches the basic laws and departmental rules.There are many ways to resolve disputes among family doctors.Non-proceeding means to resolve disputes is a better choice.
