Article 81 of the Tort Liability Law provides the responsibility for damage caused by zoo animals.This article stipulates that in the case of Chapter 10,that is,the damage caused by animals,it is the responsibility of a special type of subject.The identification of the zoo should consider public welfare and openness as factors.Wildlife zoo and wildlife sanctuary are all zoos in tort law,and zoo animals should be considered to adopt comprehensive standards.For the scope of application,the responsibility of zoo animals for damage and the responsibility for breach of security obligations should be strictly distinguished.There are fundamental differences between the two,in the rules of proof of responsibility,the scope of liability and the conditions applicable.Articles 81 and 37 of Tort liability law are the relationship between special clauses and general clauses.As the defense of the responsibility of zoo animals,the professional standards should be adopted in the determination of management responsibilities,The connotation of management responsibilities should be adjusted according to the time dimension and combined with the case.The determination of the victim's fault should be based on Articles 26 and 27 of the Tort Liability Law.Obviously lacking the attention of the average person is a gross negligence,The general negligence is based on reasonable people.
