Research On Unfair Competitiveness Cognizance Of Online Bill Brushing Behavior

With the popularity of the Internet and the continuous maturity of e-commerce technology,a large number of e-commerce platforms have risen rapidly,and "Internet+" has become a new normal for the development of modern economy.Greatly changed people's life mode,online shopping has become a new way of consumption.However,while the Internet promotes social consumption and economic growth,there are also many legal problems,one of which is online billing.Bill-brushing behavior is seriously disturbing the normal order of network operation.The legal identification of bill-brushing behavior on the network has become a problem that we can not ignore.With the development of Internet economy,online bill-brushing behavior has gradually evolved into many forms.It is also based on this.In legal practice,there are some disputes about the nature of bill-brushing behavior,which has also aroused many discussions in academic circles.The Anti-Unfair Competition Law of the People's Republic of China,which came into effect in 2018,adds new provisions to the extension of traditional unfair competition on the basis of fully considering the application of law to the network unfair competition.China's legislation is constantly strengthening the attention and regulation of emerging issues in the network environment.The author's research and Thinking on the issue of bill brushing is also derived from such legislative ideas,which conforms to the needs of the development of society and the times.The main body of this paper is divided into five parts.The first part is an introduction,which mainly includes the background and significance of the topic,literature review and research methods;the second part is an overview of online bill-brushing behavior.This part introduces several typical bill-brushing cases,raises the main controversial points of the case and the difficulties encountered in legal practice,and introduces the operation mode,characteristics and types of bill-brushing behavior.The third part is the analysis of the unfair competitiveness of online bill-brushing.This chapter is the key chapter of the paper.By combining with relevantcases,the paper demonstrates and analyses the unfair competitiveness of bill-brushing from different angles.It is generally divided into two angles.First,from the theoretical aspect,it discusses the bill-brushing behavior in the light of China's legislation and relevant academic theories.Emphasis is laid on the analysis of the relationship between bill-brushing behavior and false propaganda,fictitious transactions and commercial defamation.Secondly,from a practical point of view,combined with specific cases,the nature of bill-brushing behavior is identified by law enforcement organs and judicial organs in practice.The fourth part introduces the current legislative situation of our country and summarizes the problems in practice,and the fifth part puts forward the regulation of online bill-brushing behavior.Some suggestions.The author hopes that through the research and discussion of this topic,it can provide some solutions for further standardizing the network competitive environment and ensuring the stable development of e-commerce.
