The illegal criminal behavior of drug crime will directly affect the health of drug addicts until their lives,and then make this society's most basic unit "family" fragmented,and eventually become a hidden danger of social security and stability.At present,the transportation and possession of drugs are among the most frequent and widespread forms of drug crime in the world.In our country,although the relevant laws and regulations and minutes of meetings such as the minutes of the Dalian Conference and the Wuhan Conference have clearly regulated this,how to determine the subjective factors in the crime of transporting drugs and how to determine the way in which drugs are transported and held? There are different opinions on how to distinguish between accessories to the main perpetrators of drug crimes.In the application of law,how to correctly convict and sentence a case is directly related to the social management order,the construction of the rule of law,and the maintenance of public security and stability.Taking the drug crime cases of Zhaoxingang and Lixiaobin as the starting point,this article is divided into four parts to analyze the behavior of suspects holding drugs in judicial practice.Should the crime of illegal possession of drugs be criminalized and punished,or should the crime of transporting drugs be used as a criminal law?
