Research On Legal Relationship And Responsibility Distribution Of Private Driving Agency

Since China incorporated drunk driving into the amendment to the criminal law(viii)in 2011,more and more people need to use the service of surrogate driving,and the industry of surrogate driving has been given the opportunity to develop rapidly in this wave.With the service of driving on behalf of more and more into people’s lives,there are also more and more road traffic accidents caused by driving on behalf of others.Due to the lag of the legislation related to driving on behalf of others,there are different opinions on legal issues related to driving on behalf of others in both the judicial and theoretical circles.In this paper,the driving agent is divided into two categories of paid and free respectively to analyze its legal nature,and put forward the solution to the liability distribution in the case of traffic accident.It is expected to provide some theoretical basis for handling disputes on behalf of driving in judicial practice and guarantee the development of the industry on behalf of driving.In this paper,the author of the private driving on behalf of the motor vehicle research mainly has the following aspects: the first chapter is the introduction of this paper,mainly on the selection of private driving background,literature review and structure arrangement.The second chapter,based on the cases of infringement accidents caused by acting drivers in China’s judicial practice,introduces the current problems in judicial practice of acting drivers,and analyzes the legal relationship between the subjects of acting drivers.The third chapter discusses the distribution of legal responsibility for driving on behalf of the current civil legal norms in China,and will analyze the legal responsibility from different situations.Chapter four makes a summary according to the legal analysis of driving on behalf of the previous text.
