The problem of cross-border crime poses a danger to both Uzbekistan and the entire world community.The lack of proper legal cooperation between states leads to the emergence and spread of dangerous practice when criminals are committing a crime in one country illegally cross the borders of another to avoid the administration of criminal justice.It becomes obvious what an important role the extradition institution plays for Uzbekistan and international criminal law.The problem of extradition of criminals is one of the most difficult in the global fight against crime,as it directly affects the issues of the sovereignty of the states concerned.A special place in the cooperation of states in the fight against crime is the extradition of persons who left after committing a crime to another country.To bring each of these persons to trial or execute a sentence already passed,it is required to return him to the country where he committed the crime.Such extradition is provided for by bilateral treaties on legal assistance in criminal matters or multilateral extradition conventions.It also demonstrates from the side the judicial practice and legislative procedures concerning extradition in the Republic of Uzbekistan.When balancing the relevant provisions of the domestic law and international law on the extradition system,it draws conclusions and sufficient practical suggestions that are beneficial toscience.With regard to the field of lawmaking,opinions on the further improvement of the Criminal Procedure Law have been put forward and the rules and methods for improving the effectiveness of relevant activities in the field of extradition by Uzbekistan law enforcement agencies have been clarified.In the field of law enforcement,the existing criminal procedure law has been improved and eliminated on the absence and drawbacks of the extradition system.And this paper puts forward constructive opinions on the existing legal system and procedures.In addition,based on the comparison of the extradition system of other countries and the extradition practice of Uzbekistan,the authors' own opinions on the extradition system of the Republic of Uzbekistan were put forward.In practice,this thesis studies a group of problems arising from the extradition system.The nature of the phenomenon,that is,the signing and distribution of the documents for extradition,the mandatory and extradition reasons for extradition,etc.,explain the extradition system.According to the Code of Criminal Procedure of the Republic of Uzbekistan,the person is extradited in cases and the manner provided for by international treaties and agreements(art.8).The question arises: what if there are no bilateral treaties or multilateral conventions,and this problem is not resolved in the national criminal procedure law? In this case,what to do with a person detained on the territory of the republic and wanted at the international level or,conversely,when a personwanted by law enforcement agencies of the republic is established or detained in foreign countries? Therefore,issues regulating extradition,pre-extradition,including pre-arrest,sending a request for provisional arrest,grounds for refusing extradition require in-depth scientific development.At the same time,partial settlement of the extradition problem makes it difficult to carry out the arrest and preliminary arrest of a person,the use of Interpol circulars("red notices")in resolving the issue of detention,gives rise to certain discrepancies among scientific and practical workers.All this testifies to the relevance of the proposed dissertation research.The structure of the thesis is determined by the nature of the problems studied in it and consists of an introduction,three chapters(ten paragraphs),conclusions,a list of sources and literature used,and annexes.
