Study On The Perfection Of Approval System For Local Laws And Regulations In Cities Divided Into Districts

The Third Session of the 12^th National People’s Congress adopted the Decision on Amending the Legislative Law of the People’s Republic of China on March 15,2015,which allowed the people’s congresses and the sanding committees in cities divided into districts have the right of formulating local regulations.This has led to the expansion of the main part in local legislations in China,so that the transition of legislative power from the larger cities to cities divided into districts can be achieved.It indicated that the legislation system of socialism with Chinese characteristics has become increasingly perfect.However,the approval system of local regulations was established in cities divided into districts to ensure the legitimacy and orderly legislation in local legislation and prevent the abuse of local legislative power due to the different levels of legislation in cities divided into districts.The aticle 72 of the Legislative Law of the People’s Republic of China establishes the approval system for the local legislation through Standing Committee of Provincial People’s Congress to cities divided into districts.While the content and procedures of the approval system in it are not specifically required in detail.A perfect approval system is benefical to the development of local legislation,this paper is going to explores this.By combining the process and results of the local regulations in provinces and the current analysis in practise of each provinces.The author proposes countermeasures to improve the approval system and here are the following three parts that mainly studied with:The first part mainly introduces the basic meaning of the approval system in cities divided into districts.Including the connotation of thelegislative approval system in cities divided into districts and the nature of the approval authority and the value of this system.The second part presents the problems of the approval system existing in cities divided into districts by combining the practical situation and theoretical analysis about local legislation in each province.It is mainly reflected in two major aspects.One is that the content of the Legislative Approval System in cities divided into districts is not detailed.And the procedures of the approval system in it are not standardized.The third part puts forward corresponding suggestions for the above problems in order to easily realize the value of the approval system.The author mainly analysze this theme in two aspects.The first aspect is the suggestions for improving content and procedures.About the content of the approval,the legality should be adopted as the sole criterion for approval when it approved by the Standing Committee of the Provincial People’s Congress.And for the procedures for approval,there should be detailed procedures to follow.The National people’s congress and its standing committees in cities divided into districts should have the authiroty to explain when there is a deliberation.The second aspect is the highlight of this paper,and it proposes a way to improve the approval system.The author tends to use the specific decision-making method to specifically refine the approval system.
