A Study On The Legislation In The Evaluation Procedure Of The Image Of The Rule Of Law Of County Governments

The Hunan Provincial Law Society's Law Research Association on Procedural Law,as a third party body,carries out the appraisal of the image of the county-level government's rule of law.The purpose is to urge the county-level government to pay attention to the image of the rule of law,speed up the construction of the rule of law in China,and provide a popular platform for citizens to exercise the supervision power granted by the Constitution.At the same time,it provides civil society groups with a pioneering direction for development.From 2014 to 2018,the review activities have successfully held four sessions,the fifth session has yet to produce the final result in 2018.On the whole,the review process shows a stable development trend,the entire deliberation can be divided into the deliberation information collection stage,the deliberation stage and the announcement stage of the deliberation results.Each stage has corresponding procedural rules,which regulate the deliberation activities at different stages of deliberation.In the practice of Fangzai's exploration of previous sessions of the activity organization,the entire review process has begun to be institutionalized.However,since the review process has not yet risen to the level of the legal system,the actual operation of the review process has a great deal of arbitrariness.At the same time,the object of deliberation activities is the image of the rule of law of the county-level government,which refers directly to the government agencies with public management functions.In order to bring about a good impact on the entire deliberation process,it is also necessary to ensure the orderly and continuous development of deliberation.The deliberation procedure must be bound and guaranteed by the law and set on the track of legalization.Firstly,from a theoretical point of view,the independent evaluation activities of the third-party subjects are relatively independent of the party and government organs.Therefore,the procedural rules under the entire appraisal activities have the characteristics of independence and neutrality,and embody the theoretical value of procedural justice.The objective of the rule of law image evaluation of county government is to promote the improvement of the image of the rule of law and enhance the ability of the government to serve the people.Secondly,from the existing practice,there are reference items in the evaluation model of China University of Political Science and Law that can be used to institutionalize the appraisal process of the image of the county government.In addition,according to the legal process of the foreign minister's similar review,there have been reviews of "everywhere" in the United States and other countries.In order to save social resources,the United States has put the review on the right track and passed the way of congressional legislation to regulate the deliberation.Since then,the review of the United States has moved from the "legal system" to the "rule of law." Finally,combining the above information,the author explores the way of the legalization of the review procedure in Hunan Province.According to China's National conditions,the common practice for new things is to pilot local legislation,and the "Legislative Law" has given certain local legislative authority.Therefore,Authorities and competent governments in Hunan province may adopt legislation to regulate the process of assessing the image of the county government.
