The Main Legal Dilemma And Protection Of Chinese Family Trust

Family Trust system,originated from the ancient Britain Uses system,has become an important system for family wealth inheritance and assets management.Now,it is widely used in global financial institutions and high net worth groups.Family trust helps high net worth groups defend uncertain risks when their family or enterprise assets encounter inheritance,marriage or enterprise operation through rigorous structure.It can realize five functions including family assets allocation,transaction management,assets inheritance,insurance security and public welfare.In the recent decade,our country's family trust demand rises with the development of assets scale and high net wealth groups.The first domestic family trust which founded in 2013 has triggered different types of family trust's practice.However,our country's traditional wealth values is in the period of transition.The law practice with the trust law enacted in 2001 pay attention on investment and finance instead of trust origination.The family trust law system has been backward.Therefore,the application of family trust in the domestic wealth management is far behind and faced with the dilemma of law definition and set of system.So,it cannot play a positive role in today's domestic wealth management and inheritance.To implement the role and function of family trust,the first chapter focuses on the origin,conception,function and existing model of family trust.The second chapter emphasizes on the blank area of practice and law and discuss our country's core law issues of family trust.The law problems negative influence on our country's family trust development would be discussed in the third chapter.In the end,the author would put forward a clear family trust law system to help our country's family trust and wealth management development at the basis of overseas experience and system.
