Thoughts On Perfecting The System Of Plea For Leniency

The system of plea for leniency is produced by the light-punishment of crime.It is an important content of the new round of Judicial System Reform in our country.It also reflects one kind of balance when to pursue justice also give consideration to the efficiency,according with the development of international modern criminal justice.Now every experimental place are working on this.It has been achieved at a certain stage from the consistency between prosecute and judgment and low-rate on appeal.At the same time,we also found some problems,that results in the low application rate of each experimental place.We must analyze the reasons and make summaries.The purpose of this paper is to investigate the application of "plea for leniency system" in the People's Procuratorate of P District in Shanghai,to analyze the issues like how to deal with the different range of application,standard of sentencing,and how to exercise the discretionary power fair,the lack of supporting system in present practice.In order to put some feasible suggestions on perfecting the "plea for leniency system" with the theoretical research,actual data and the experience of some countries and regions,to fully realize the legal value and social value of the system.
