The Study On The Risks Of Overseas Immigrant Funds And The Protection Of Chinese Investors

Because of the 2008 financial crisis,Western countries began to pay attention to attract foreign capital through immigration funds: foreigners obtain the permanent residence of this country through investment;the number of Chinese citizens who immigrate overseas through investment continues to grow.This paper focuses on the characteristics and risks of immigration funds,analyzes and explores how to protect Chinese investors.Using the comparative,literature and empirical research methods,and taking the United States for example,this paper deeply analyzes the nature,risks and scandals of immigration fund,and study from the experience and legislation in US and Taiwan,to explore how to strengthen the government and social organizations to protect the interests of Chinese investors.There are five chapters as follows:Chapter One,introduces and compares the investment immigration policies of United States,Canada,Australia,and Singapore,which are the main immigration destinations for Chinese citizens.Chapter Two and Three,taking the United States,the first choice of Chinese citizens' overseas immigration destination,for example,analyzes the nature and risks of immigration fund.Because the US immigration law requires the capital is “at risk”,the investors must face two major risks come from immigration and business.Chapter Four,through the SEC typical cases,the immigration fund problems,such as fraud,misappropriation of funds,violation of SEC regulation and other issues are reflected.Chapter Five,learn from the legislation and practice of the United States and Taiwan,to explore how to play the roles of Chinese government and social organizations,such as supervise the landing of overseas immigration funds on China,strengthen the integrity of the industry,provide professional services,to protect Chinese investors from being victims in overseas investment and immigration.
