With further globalization and China's deepening reform and open up,a worldwide population mobilization is ongoing.Due to multiple factors,we are witnessing an increasing number of illegal immigration.Illegal immigration includes but is not limited to smuggling and illegal detention.Amongst all types of illegal immigration,smuggling is deemed as one of the most drastic and detrimental way.As the number of illegal immigration cases is increasing dramatically with diverse means,it brings new challenges to China's current entry and exit governance.Since illegal immigration cases become more and more complicated,it makes China's current legal system difficult to address these cases as the existing laws and regulations have a rather narrow coverage and poor applicability,with an enforcement system that need to be improved.This paper focuses on the issue of China's illegal immigrant smuggling and aims to shed lights on the legislation of illegal immigrant smuggling and its enforcement.This paper is divided into four chapters:(1)Chapter 1 provides a brief introduction to the problem and discusses the definition and concept of illegal immigrant smuggling;it also analyzes the status of smuggling with which China is currently confronted and its damage.(2)Chapter 2 analyzes the underlying reasons of illegal immigrant smuggling from China's economic,historical,cultural and legal background.(3)Chapter 3 purports to identify the problems rooted in China's legislation and law enforcement in the context of illegal immigrant smuggling and gain some experience from foreign laws and cases in this regard so as to find a solution to the current difficulty in addressing illegal immigrant smuggling cases;(4)Chapter 4 concludes the paper with some suggestions on China's governance of illegal immigrant smuggling from both legislative and law enforcement perspective.
