The Research On Artificial Intelligence As Special Civil Subject

Artificial Intelligence(abbreviated as AI)is developing rapidly for the moment,which has been applying widely among social life and trading activity.People's impression upon AI has been changed with its new characters such as massive data/cloud computing/neural networks/deep learning.While AI has brought human convenience and effectiveness,law has to face challenge.AS is known,AI has experienced three stages and each step's progress means the requirement for law's adjustment.Especially under the circumstances that AI's degree of autonomy and self-awareness has obviously strengthened,AI is keeping pace with Human being's wisdom,as result AI's civil subject qualification an unavoidable issue.This article will try to analysis the law risk resulted from AI's development based on AI's developed course and status quo and then discuss the necessity and possibility about AI being special civil subject.AI's challenge upon civil subject theory shall focus on origin and character of natural person and law person,especially about the challenge on civil rights capability/civil conduct capability/civil liability capability theory.Related to the necessity of AI's civil subject qualification,this article will start from AI's self-determination capability which has changed the traditional civil activity,meanwhile will discuss when AI take party in some civil activities what civil rights is needed/ whether AI's conduct is effective/How civil liability is shared.About the possibility of AI's civil subject qualification,this article shall deal with AI's civil rights capability/civil conduct capability/civil liability capability.Firstly,about rights,this article shall insist the principle that no harm to human being.Secondly,about conduct,AI has been classified as no civil conduct capability/restricted civil conduct capability/complete civil conduct capability.Finally,AI's civil liability capability aims to resolve the liability resulted from AI's conduct.Anyhow AI has effected civil subject theory and is worthy for some change from the law.
