Study On The Justiciability Of Administrative Confirmation

Administrative confirmation is an important part of national public administration,which covers a wide range of areas and involves all aspects of public life.But because of the lack of a system of legal norms,the exercise of administrative confirmation of authority,there are still many non-standard place,such as administrative confirmation enactment right unclear problems and confirmed by the administrative rights disputes caused by the the question of whether or not to can be filed court for judicial review,increasingly attracting the attention of the public and scholars attention.This paper attempts to make a further discussion on the justiciability of administrative confirmation on the basis of summarizing the previous research results.In addition to the introduction,this paper is divided into four parts.In the first part,the author makes some basic definitions on the definition,behavior nature and classification of administrative confirmation.The author believes that it is particularly necessary to discuss the justiciability of the following administrative confirmation in order to clarify the behavioral nature of administrative confirmation.In the second part,the author demonstrates the justiciability of administrative confirmation from three perspectives: theoretical basis,legal interpretation and social practice.In the third part,the author summarizes several main problems affecting the litigability of administrative confirmation in China from two aspects of legislation and legal practice.The fourth part,based on the problems mentioned above,puts forward some corresponding Suggestions.
