Research On Tort Liability Of Artificial Intelligence

Artificial intelligence technology is mainly used to simulate the operation of the human brain,so as to use machines to expand human intelligence and develop new theories and new methods to improve the efficiency of human social practice.Since it was put forward in the 1950 s,it has presented a trend of accelerated development worldwide.At present,the technology has been widely explored and applied in the fields of transportation,finance,medical care,Internet and management,etc.,and has become a new technological means to effectively improve the efficiency of production and management.Different from the past,when machines were merely auxiliary tools for human production and life,the autonomy,learnability and applicability of artificial intelligence technology have been continuously enhanced.It is not only possible to engage in some repetitive work independently,but also to create activities beyond the scope of the set program.Artificial intelligence with independent thinking,decision-making,implementation of creative behavior to others property,physical and mental damage,who will assume tort liability,how to carry out responsibility identification,and how to share the responsibility and the responsibility of predictable challenges,the inadequate sex and limitations of tort law,contract law gradually revealed,the new rules of the law of demand is also becoming more and more urgent.This paper will analyze from three aspects.The first part: the development background,concept and main application fields of artificial intelligence are summarized.This paper introduces three viewpoints on the legal status of artificial intelligence in the current academic circle,and through a comprehensive view of the different defects of the three theories,establishes the starting point of this paper.The second part: with the help of the current tort liability system theory,especially the tort liability law,combined with relevant examples,taking the issue of artificial intelligence tort liability as the entry point,this part focuses on the problems existing in the application of traditional tort liability under the artificial intelligenceenvironment.Specifically,it mainly involves the subject of liability,the principle of attribution,the identification of responsibility,and the assumption of responsibility for the infringement of artificial intelligence.The third part: finally,combining with the current development trend of artificial intelligence,And the advanced experience of the European Union,the United States and the United Kingdom in exploring legislative norms on artificial intelligence related to intelligent robots and self-driving cars,combining with China's reasonable Suggestions to improve the construction of China's artificial intelligence tort liability system.
