Today,China has entered the automobile era,and the number of residents' car ownership has exploded.It has reached an unprecedented level.What followed is the problem of “difficult parking”,which is highlighted by the continuous increase in the number of private cars.There is a contradiction in the number of garage parking spaces.Cracking the parking problem is related to China's urbanization process,the development of the automobile industry and the public's sense of well-being,security and acquisition.The primary problem in exploring the problem of parking parking is to effectively explore the legal nature of garage parking spaces.A residential community garage is a place that is installed in a residential community space for the purpose of parking a motor vehicle.Along with the dual development of society and science and technology,the per capita possession of Chinese residents' vehicles has risen sharply.At the same time,it faces the difficulty of parking in residential areas.Before the "Property Law" was introduced,China's ownership of parking spaces was basically blank.Until the "Property Law" was introduced,the problem of ownership of ground parking ownership was basically solved.However,things have two sides.The "property law" solves the problem of ownership of ground parking ownership,and because the regulations are too simple and rough,there is a situation in which the operability is lacking when faced with real problems.Nowadays,the most typical ownership of the garage is a new dispute,which has triggered a dispute between real estate developers and owners.This paper is divided into four parts to discuss the ownership system of garage parking spaces in China's commercial housing.The first part analyzes the category of garage parking spaces and the theory of rights attribution.This paper thinks that there are five types of garage parking spaces in residential commercial residential areas in China,namely,completely independent garage parking spaces,ground garage parking spaces,and the first floor overhead parking spaces of buildings.The roof platform parking space,the garage parking space modified by the civil air defense project,is planned to park the parking space of the car.The second part explains the legal regulations of garage parking spaces in commercial residential quarters in China,and sorts out the problems existing in the ownership of rights.It points out that it mainly focuses on three aspects,namely whether it is necessary to "first meet the needs of the owners" as mandatory.The norm violates the consequences of “should meet the needs of the owners first” and the meaning of“first” in the “first meet the needs of the owners”.The third part will compare and analyze the tenure rules of the German and German law days and the garage parking spaces in Taiwan,and classify the garage parking space ownership legislation.The fourth part puts forward the viewpoint of this paper on the ownership of garage parking spaces in China,and proposes to classify and strengthen the management of garage parking spaces to realize the rights and interests of community owners.
