The Reflection And Reform Of Chinese Family Judging System

Family judging system is one of the important steps of judicial reform.There are much more family disputes in the last few years,specially,some new cases are coming up which are more difficult to resolve.It can never be handled like civil dispute with old system.Therefore,the Supreme Court conducts two years pilot reform of family matter judgement among 100 intermediate and basic courts on June 1st 2016.Du Wan Hua,a full time member of judicial committee from the Supreme People's Court,thinks that marital and familia relation is the basic social relationship.In the last 3years,there are more than 1.5 million cases about the dispute of marriage and family succession from the first trial by the courts of China,which takes around 30% of civil case.The trend is increasing every year.There will be a great influence if can not find a good solution.Therefore,it is necessary to reform the judge way and working system of marriage and family case.In 2017,Fujian Higher Court brings up the instruction of the reform on family judging system.It points out necessary reform of family judging system with creative and special way.This paper takes the example of H county town of Z city to analyze the status and particularity of family dispute case and to stress the importance of building a family judging court.There are many problems of family judge under judicial practice,such as,the current way can not handle with the particularity of family case,the problem involving the right of juvenile,and there are some difficulties of attending court,collecting proof and implementing in family case.At the same time,there of short of professional person on family marriage relations to handle with family judging case.Based on the family judging system of domestic pilot like HAI CANG MODE and WENZHOU MODE,this paper analyzed the useful method and its effect to make a conclusion.Combined the hardware and software facility is important to build a special family judging system.
